This page states the website terms and conditions (Terms & Conditions) under which Members and or users (collectively “Users”) may use this website.
Access to this website and the use of information on it is subject to these Terms & Conditions and Privacy Statement and if and when ICAG permits registration and or membership and any Membership Agreement. If and when ICAG permits registration and or membership, Members must register and agree to abide by the Membership Agreement and related member terms and conditions (any and all of which may be amended, replaced and or updated from time to time). You should carefully read all of these terms. By proceeding further, you agree and will be deemed to have accepted them.
You are only authorised to use the ICAG website (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the ICAG website and discontinue use of the ICAG website immediately.
This Agreement includes ICAG’s policy for acceptable use of the ICAG website and Content posted on the ICAG website, your rights, obligations and restrictions regarding your use of the ICAG website.
ICAG may modify this Agreement from time to time and such modification shall be effective upon posting by ICAG on the ICAG website. You agree to be bound to any changes to this Agreement when you use the ICAG website after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.
Please choose carefully the information you post on ICAG and that you provide to other Users (if permitted to do so). Information provided by other ICAG users, members and or operators (if permitted) may be inaccurate, out of date, inappropriate or incomplete, and ICAG assumes no responsibility or liability for this material. If you become aware of misuse of the ICAG website by any person, please contact ICAG immediately.
ICAG reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you (if permitted), or to restrict, suspend, or terminate your access to all or any part of the ICAG website at any time, for any or no reason, with or without prior notice, and without liability.
By using and or registering with the ICAG website, you represent and warrant that you have the capacity to understand, agree to and comply with these terms. You should provide true, accurate and complete registration information if and when required. As part of any registration process, you will be asked to select a username and password and you will be responsible for all activities occurring under your username and for keeping your password secure. We may refuse to grant you a username that impersonates someone else, is or may be protected by trade mark or proprietary rights law, or is vulgar, offensive or otherwise inappropriate, as determined by us in our sole discretion.
Definitions
In these Terms & Conditions of Use, the following terms shall mean:-
“ICAG” means ICA Gormanston Guild of C/O Ms Brigid Fanning, Clonalvy, Co Meath;
“Member(s)” means a current validly registered member for the time being ICAG and of the ICAG website;
“Privacy Statement” means our statement of practice as regards the privacy and security of your information when accessing and/or using this website and any of the features and services on or available through it;
“Services” means the information, content, navigation information, advertising and or navigation products and services provided by or via ICAG to Members and or such limited access which may be permitted to Users (if any);
“you” means any and all persons accessing or using this website and/or availing of any information and/or services available on or via this website;
“we” and “our” and “us” means ICAG.
General
We reserve the right to change, amend or replace these Terms & Conditions (in whole or in part) at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
When you use certain services please read the additional information with regards to such services.
All activities, products and services are subject to availability.
We do not agree to store details of your (purchases and or) reservations (if permitted), so please print out these terms and conditions and the reservation details (where applicable) for your own records.
Risk of delay, loss and damage in relation to your and or third party products, services and or timetables is solely your responsibility.
Information/Schedules/Etc
ICAG cannot be held responsible (and does not have the staff or resources to verify information. We do not check or verify your or third party information, details, etc. The sole responsibility for using and or relying on data and or information or third parties is on users. Information may become out of date or may contain inaccurate or inappropriate material.
Member Conduct and Appropriate Content
The ICAG website is made available for your personal, non-commercial use only. You may not use the ICAG website for any illegal or unauthorised purpose. International users (if permitted) agree to comply with all local rules regarding online conduct and acceptable content. You are solely responsible for your conduct and any data, text, information, graphics, photos, profiles, audio and video clips, links and other content (if permitted)(“Materials”) that you submit, post and display on the ICAG website (if permitted). We may, but shall have no obligation to, remove Materials that we determine in our sole discretion are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any partys intellectual property or other proprietary rights or these terms. Further, under no circumstances does ICAG have any obligation to check the accuracy or truthfulness of the any Materials, nor to monitor any Members use of the ICAG website.
Conditions for Use
You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your account made by you including the content of your transmissions through postings or the ICAG website. | | Submit Materials that are unlawful or promote or encourage illegal activity or that would violate the property rights of others; |
| | Submit Materials of any third party without such third partys prior written consent, or Materials that falsely express or imply that such Materials are sponsored or endorsed by ICAG; |
| | Create a false or misleading identity of another individual or falsely state or otherwise misrepresent your affiliation with a person or entity, for the purpose of misleading others as to the identity of the sender or the origin of a message or to harvest or otherwise collect information about others; |
| | Transmit, email or post any material that contains in any form software viruses or such programs as including but not limited to, Trojan horses, worms, time bombs, cancel-bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; |
| | Use the ICAG website in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website; |
| | Attempt to gain unauthorised access to the ICAG website, other accounts, computer systems or networks connected to the ICAG website, through password mining or any other means; |
| | Modify, adapt, translate, or reverse engineer any portion of the ICAG website, or use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion or the ICAG website; |

| | Posting any franchise, pyramid scheme, “club Membership,” distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary), requires recruitment of other Members, sub-distributors or sub-agents;

| | Deleting or revising any material posted by any other person or entity; |
| | Using any device, software or routine to interfere or attempt to interfere with the proper working of any ICAG website or any activity being conducted thereon; |
| | Taking any action, which imposes an unreasonable or disproportionately large load on any ICAG website’s infrastructure; |
| | Disclosing to or sharing a password or ticket code with any party that is not expressly permitted to use such password, or using a password for any unauthorised purpose; |
| | Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of any ICAG website; |
| | Accessing or downloading any content or publications more than once; |
| | Attempting to reverse engineer or disable, amend, alter or bypass any security information, coding, encryption, use restrictions or embedded information or identifiers. |

ICAG grants a non-exclusive non-transferable, limited personal licence to Members and or Users to view and or access copies of (i) the publicly accessible material and (ii) the material available from those additional areas of the website to which Members may be permitted access pursuant to the terms of these terms and conditions and or the Membership Agreement on the website and any other websites under ICAG’s control (whether partial or otherwise) (if permitted) (collectively “ICAG Website(s)”) for User’s personal use in accordance with the terms and conditions of these Terms & Conditions and or the Privacy Statement and such other terms and conditions as may be imposed by ICAG from time to time at its sole discretion.

Conditions for Use
The contents of ICAG websites, such as text, graphics, images, logos, button icons, software and other Material are protected under European Union, Irish and international copyright, database right, sui generis right, trade mark and other intellectual property laws. Except as provided in the Membership Agreement, all Material is the property of ICAG and or its content suppliers or clients. The compilation (meaning the collection, arrangement and assembly) of all content on each ICAG website is the exclusive property of ICAG. Unauthorised use of the Material may violate copyright, trade mark and other laws. ICAG retains all copyright, trade mark, service-mark and other proprietary notices contained in the original Material on any copy Users makes of the Material. Users may not sell or modify the Material or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public purpose. Except to the extent owned otherwise permitted by the Agreement, the use of the Material on any other website or in a networked computer environment or any other communications or technology device or for any purpose is prohibited. Users and or Members are not authorised to sell, licence, forward or copy the Material to any other communications or technology device nor to forward, sell, licence, copy or distribute the Material to any other party whatsoever and wheresoever.
Users may not copy or adapt the HTML code that ICAG creates to generate its pages. Such HTML code is also protected by ICAG’s copyright.
Acceptable Website Use
General Rules: Users may not use any ICAG website in order to transmit, distribute, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trade mark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, harassing abusive or hateful, or (d) is otherwise a breach of the Terms & Conditions for the time being.
ICAG Website Security Rules

However, you should note that messages and information passing over the Internet may not be free from interference by third parties and should be independently verified. You should never disclose data over the Internet in any manner unless you have satisfied yourself as to the security of the related technology/encryption. Please note that ICAG cannot guarantee the privacy or confidentiality of information relating to you passing over the Internet. In accessing this website and in availing of any of the services/information available on or via this website, you are deemed by these Terms & Conditions to accept that electronic mail messaging and Internet communication may not be free from interference by third parties and may not remain confidential. Proprietary Rights
ICAG does not claim any ownership rights in any Materials that you submit, post, or display on or through the ICAG website (if permitted). After submitting, posting or displaying Materials on or through the ICAG website (if permitted), you continue to retain all ownership rights in such Materials, and you continue to have the right to use your Materials in any way you choose. By submitting, posting or displaying any Materials on or through the ICAG website, you hereby grant to ICAG a perpetual license to use, modify, publicly perform, publicly display, reproduce, and distribute such Materials solely on and through the ICAG website. Hold Harmless and Indemnity

Limitation of Liability

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:
economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings);
loss of goodwill or reputation;
special or indirect losses;
suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
Notwithstanding the above, subject to the above paragraph our total aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) or services in respect of one incident or series of incidents attributable to the same clause.
ICAG is only a portal and information listing website and does not vet, verify, screen or censor information, listings, publications and or Material available or offered. ICAG is not involved in the actual creation or formulation of publications nor the content, views and or opinion contained in any publications or Materials. As a result, ICAG has no control over the quality, safety or legality of the publications, postings, the truth or accuracy of the listings or publications and does not have the ability to alter, amend, moderate or censor publications. In addition, please note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, local laws and customs, underage persons or people acting under false pretences. Users assume all risks associated with dealing with other users with whom Users come in contact through any ICAG Website or publication and all responsibility for their use of the website, Services, publications and all local laws and customs.
Because user authentication on the Internet is difficult, ICAG cannot and does not confirm that each user is who he, she or it claims to be. As ICAG does not and cannot be involved in user-to-user dealings or control the behaviour of participants on or via the ICAG website. In the event that a User has a dispute with one or more Users, Users release ICAG (and its officers, agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, to the extent resulting from such disputes.
ICAG is under no legal obligation to, and generally does not, control the information provided by publishers, suppliers and or other users which may be made available or accessible through or via the ICAG website. By its very nature, other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabelled or deceptively labelled. ICAG expects that Users will use caution and common sense when using ICAG websites.
The Material may contain inaccuracies or typographical errors. Except and only to the extent expressly provided to the contrary in the Agreement, (i) ICAG makes no representations about the accuracy, reliability, completeness, or timeliness of ICAG websites or the Material and (ii) changes are periodically made by ICAG to the ICAG website and may be made by ICAG at any time and without notice.
Users acknowledge and agree that they are solely responsible for the form, content and accuracy of any publications and or Material posting or any content placed by publishers, suppliers and or Users on the ICAG website.
ICAG is not responsible for any User travel, arrangements, reservations, plans, purchasing, licensing, accessing or downloading decisions.
ICAG endeavours to provide generally accurate details wherever and whenever possible. ICAG (nor any other person involved with the provision and maintenance of this website or publishers) takes any responsibility for the accuracy of the information provided on or via this website. Use and reliance of such information is at the Users sole risk. ICAG does not accept any liability for any loss or damage of any nature, including but not limited to loss of profits, goodwill, or any other type of financial or other pecuniary or direct or special indirect or consequential loss howsoever arising whether in negligence or for breach of contract or other duty as a result of:

ICAG makes no representation or warranty or undertaking of any kind in relation to the analysis or information contained on this website or the completeness or accuracy of such information. In the event of any liability whatsoever arising, such liability shall be capped and limited to the amount of any Membership fee received or the value of the last registration or transaction whichever is higher. In the event of any cancelled or delayed reservation or trip or booking ICAG does not accept any liability whatsover.
User Submissions (if permitted)
Users are responsible for their own communications and for the consequences of postings and other submissions of Users, if any. Users shall not do the following things: post material that is copyrighted, unless the User is the copyright owner or has the permission of the copyright owner to post it; post material that reveals trade secrets, unless the User owns them or has the permission of the owner; post material that infringes on any other intellectual property rights of others or on the privacy data protection or publicity rights of others; post material that is obscene, defamatory, threatening, harassing, abusive or hateful; post sexually-explicit images or statements; post advertisements or solicitations of business other than as contemplated by the Agreement, post chain letters or pyramid schemes; impersonate another person; or post material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.
ICAG does not represent or guarantee the truthfulness, accuracy, legality or reliability of communications posted by users or endorse any opinions expressed by Users or publishers or authors. Users acknowledge that any reliance on material posted on any ICAG website will be at the User’s own risk.
ICAG acts as a passive conduit for the online distribution and publication of information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If notified by the User or any other user of communications which allegedly do not conform to the Agreement or these Terms & Conditions or, with respect to non-member users of any ICAG website, which do not conform to the terms of use applicable to the public access areas of any ICAG website, ICAG may investigate the allegation and determine in its sole discretion whether to remove or request the removal of the communication. ICAG has no liability or responsibility to Users or other users for performance or nonperformance of such activities. Registration and Password
Users are responsible for maintaining the confidentiality of its information and password(s) assigned to Users and including ticket coding, passwords and related information and access permissions. Users shall immediately notify ICAG of any unauthorised use of any password, tickets, coding, etc. of which Users become aware.
